Marvel believes an Instagram account familiar to many has posted an illegal image from and wishes to find out the alleged leaker’s identity. As a result, the company has gone to court and demanded Instagram unmask the person.
On May 7, 2024, Marvel filed a subpoena request in San Jose’s U.S. District Court California Northern District. The company wanted the court to order Instagram to identify the person or people behind the @CanWeGetSomeToast Instagram account (via piracy-news site TorrentFreak).
The account reportedly “published a copyrighted image from an upcoming Marvel Studios motion picture, ‘Captain America: Brave New World,’ without authorization.” As a result, Marvel filed for a court order as per the Digital Millennium Copyright Act.
For those unaware, @CanWeGetSomeToast originally found popularity on X (formerly Twitter). The user, who first established herself through the separate handle of @MyTimeToShineHello, and made her name revealing MCU scoops.
While some of the scoops shared on both accounts were incorrect, others turned out to be true, including the one where she correctly revealed the new title of Captain America: Brave New World a month before Marvel’s announcement. Such scoops allowed her to gain credibility and thousands of followers.
Now, Marvel wishes to find out the identity of the anonymous user. Furthermore, Marvel’s VP of global security and content protection, Matthew Slatoff, also made a statement supporting the subpoena.
He revealed that a senior paralegal at Walt Disney Co. also alerted Instagram about the alleged Captain America: Brave New World leaker sharing the copyrighted image in an Instagram Story. Instagram has yet to comment on the story while the account in question remains to be active.
